OPTAMIA LOYALTY REWARDS PROGRAM

TERMS AND CONDITIONS

 

Optamia Loyalty Rewards Program (the “Program”) is offered exclusively by Optamia (the “Company”, “us”, “our” or “we”). The Program is accessible through www.optamia.com (the “Program Website”) and any other related sites and applications referred to on the Program Website.

To participate in the Program, members must agree to complete the enrollment steps (each, a “Program Member” or “Member”) in accordance with the present Terms and Conditions to collect points when making purchases on items identified from time to time by the Company (“Eligible Purchases”), and to redeem these points for rewards and/or benefits offered by the Company from time to time. Optamia LLC. reserves the right to change the terms and conditions of the Rewards Program at any time without notice.

 

PROGRAM MEMBERSHIP

 

ELIGIBILITY

 

No purchase is necessary to obtain membership in the Optamia Loyalty Rewards Program. To be eligible for participation in the program, Members must be a United States resident who is able to provide complete and accurate information and indicate your acceptance of the Program Terms.

 

ENROLLMENT

 

In order to enroll in the Program, you will have to register and create an Account with us using your first and last name, valid email address, and phone number. You are solely responsible for maintaining the accuracy of your account information and for keeping it up-to-date as may be required. Members may update personal information through their online account by visiting the Website or by contacting Customer Service at info@Optamia.com

 

TERMINATION & CANCELLATION

 

The Optamia Rewards Program and its benefits are offered at Optamia’s sole discretion. Participation in the Program may be terminated at any time if such Member engages in the abuse of the Program or fails to follow the given Terms and Conditions. If membership in the Program is cancelled or terminated, all points accrued and/or benefits in your Account must be forfeited at the time of cancellation or termination.

 

PRIVACY

 

We value and respect your privacy. All personal information collected from Members will be used to provide you with any rewards or benefits that you redeem under the Program and marketing communications that you have opted in to receive.

 

USER OPT OUT

 

By sharing your email address and as an active customer and Program Member, we and/or our service providers may communicate to you special offers, services, promotions and program information. You can unsubscribe from receiving such messages at any time by updating your online account, by contacting customer service, or by clicking unsubscribe at the bottom of any promotional email.

 

EARNING POINTS

 

REWARD REDEMPTION

 

Points can be earned by Program Members on all products including gift cards made through the Company Website. Members must be signed into rewards account to receive any credit.  Points become redeemable only after 35 days have passed from purchase date or when package has been received by buyer, whichever is later.

 

Optamia Loyalty Rewards Points are non-transferrable and cannot be redeemed for cash. Points may be redeemed for rewards Online, when enough points have been accumulated to obtain the desired reward(s). Member must provide his/her Membership Login at the time of purchase when redeeming points. Points cannot be used towards the payment of sales tax and cannot be exchanged or returned for another product or monetary refund.

 

You are responsible for any and all activity that occurs on your Account. If you suspect any unauthorized use of your Account, you must notify us immediately. If a Membership Number is used by any other person, all points relating to purchases made by such other person will be credited to the Member’s Account. The Company assumes no liability or responsibility for points redeemed by any person(s) prior to a notification to the Company that the Membership Number has been compromised. Any points redeemed prior to notification shall be at the Member’s risk.

 

POINTS EXPIRATION

 

All Points received do not expire while membership Account is active.

 

RETURNS & EXCHANGES

 

In the event of a return/exchange of any eligible purchase that initially earned points, rewards points will be deducted automatically from the Account in an amount equal to the points earned for the original transaction.

 

POINT PROMOTIONS

 

From time to time, Optamia may run limited time promotions to select Members to redeem points for items other than a discount reward or receive exclusive benefits. Promotions are subject to the terms and conditions of the offer, rules and restrictions will apply.

 

GENERAL

 

By enrolling in the Program, each Member (i) certifies that he or she is over the age of majority in the jurisdiction in which he or she resides (or is supervised by a parent or legal guardian who agrees to the Program Terms) and of mental capacity (or is supervised by a legal guardian who agrees to the Program Terms), (ii) consents to the company’s collection and use of certain personal information, except as he or she may otherwise notify the Company and (iii) agrees to the Program Terms, as they may be amended from time to time.

 

These Terms and Conditions are in addition to any other Program Terms and our Terms of Use and Privacy policy posted on the Program Website, and shall be read together with such other Program Terms as one and the same instrument; provided, that if there is a conflict between any terms set forth in these Terms and Conditions, the Program Website, the Explainer Page and/or any other Program Terms, such conflict shall be resolved as follows: first, the Terms of Use and Privacy policy posted on the Program Website; thereafter, the Explainer Page shall prevail; thereafter these Terms and Conditions; thereafter the Program Website; and finally any other Program Terms. For the avoidance of doubt, in the event of any action, proceeding or other dispute arising from or relating to any Program Terms, such dispute shall be settled in accordance with the provisions and procedures set forth in these Terms and Conditions.

 

DISCLAIMER

 

Every effort has been made to ensure that the information herein is correct. The Company is not responsible for any errors or omissions in printed copies of these Terms and Conditions nor those published from time to time on its website. Any waiver by the Company of the strict observance, performance or compliance by a Member with any of the Terms and Conditions contained herein, either expressly granted or by course of conduct, shall be effective only in the specific instance and shall not be deemed to be a waiver of any rights or remedies of the Company as a result of any other failure to observe, perform or comply with the Terms and Conditions. No delay or omission by the Company in exercising any right or remedy hereunder shall operate as waiver thereof or of any other right or remedy. In the event that any provision in these Terms and Conditions is determined to be invalid, illegal, or unenforceable, such determination shall not affect the validity and enforceability of any other remaining provisions of these Terms and Conditions.

 

GOVERNING LAW

 

Optamia Loyalty Rewards Program Terms and Conditions will be governed by the laws of the state of New York, without regard to any conflict of law provisions. By using this Program, you expressly consent to exclusive jurisdiction and venue in the courts located in the state of New York, County of Kings and waive any objection to such courts, including without limitation on the basis of jurisdiction, venue or inconvenience of forum.
